New Homes Guide /Trip Giveaway (“Sweepstakes”) Official Rules

This Sweepstakes is sponsored be Greater Washington Publishing Inc. d/b/a New Homes Guide (“Sponsor”). Sweepstakes is open to only legal residents of the District of Columbia, Maryland, and Virginia at the time of entry. Entrants must be 21 years of age or older at the time of entry. Employees, officers, directors and representatives of Sponsor and its corporate affiliates, and those with whom such persons are domiciled, are not eligible. Void outside of the District of Columbia, Maryland, and Virginia and where prohibited by law. Sweepstakes subject to all federal, state and local laws.

HOW TO ENTER: NO PURCHASE NECESSARY

The entry period of the Sweepstakes begins Aug 15, 2008 at 12:01am Eastern Time (“ET”) and ends on October 10, 2008 at 5:00pm ET (“Sweepstakes Entry Period”). To enter the Sweepstakes, visit the Get the Guide page and provide the requested information as directed in order to subscribe to New Homes Guide. To be eligible for the Sweepstakes, prospective contestants must submit an online request to subscribe to New Homes Guide (each an “Entry”) which must be received by Sponsor during the Sweepstakes Entry Period. There is no cost to subscribe to New Homes Guide. Limit one Entry per household. Entries that are incomplete, unreadable, inaccurate, unintelligible or otherwise not in compliance with these Official Rules will be disqualified. Sponsor is not responsible for lost, destroyed or misdirected Entries.

PRIZE

ONE (1) GRAND PRIZE. One (1) Grand Prize Winner will receive a 4-day/3-night trip for two (2) to Cancun, Mexico on dates to be approved by Sponsor in its sole discretion. Trip includes: (i) roundtrip coach class air transportation for winner and a guest between a Washington, DC metropolitan area airport (as determined by Sponsor in its sole discretion) and Cancun, Mexico, optional travel insurance not included; (ii) three (3) nights of hotel accommodations for winner and a guest (includes double occupancy room rate and room tax only); and (iii) ground transportation for winner and a guest between Mexico airport and Hotel. Total APPROXIMATE RETAIL VALUE (“ARV”) of Grand Prize: $2,000, which may vary based on airfare and hotel rate fluctuations.

Airline tickets are subject to terms and conditions stated on tickets, and additional material restrictions may apply. Airfare does not include government taxes and certain government fees. Capacity controls, blackout dates, weekend, holiday and peak season surcharges may apply. The trip must be completed within one year of winner notification or Grand Prize will be forfeited. Winner and his/her guest are not eligible for frequent flyer mileage. All travel associated with airline tickets must be completed on dates, times and to/from airports designated and/or approved by Sponsor. Winner must give a minimum of 60 days advance notice of desired departure date. Travel is subject to availability of flights and hotel, and material restrictions may apply. Tickets may not be endorsed, transferred, exchanged or refunded. Winner and his/her guest are responsible for obtaining passports and any other necessary travel-related documents and identification, and for satisfying any applicable requirements. Grand Prize Winner must be the parent or legal guardian of his/her guest if the guest is a minor under applicable state law. Winner and his/her guest must be available to travel together on dates and times specified by Sponsor or, in Sponsor’s sole discretion, prize in its entirety will be forfeited and an alternate winner may be selected (in Sponsor’s sole discretion) in accordance with these Official Rules from among the remaining eligible entrants. Winner must have a valid major credit card to secure hotel room and for incidentals and other expenses. In the event that the winner and/or his/her guest engage during the trip in behavior that (as determined by Sponsor in Sponsor’s sole discretion) is obnoxious or threatening, illegal or that is intended to annoy, abuse, threaten or harass any other person, Sponsor reserves the right to terminate the trip early, in whole or in part, and send the winner and his/her guest home with no further compensation.

All elements of prize are subject to availability. No transfer, substitution or cash equivalent of prize permitted by winner. All costs and expenses not expressly provided for in these Official Rules (including, but not limited to, any applicable fees, service charges, surcharges, unspecified accommodations, meals, in-room charges (e.g., mini-bar, room service, telephone calls), unspecified ground transportation, souvenirs and incidentals) are not included and are the sole responsibility of winner. Winner is solely responsible for obtaining travel insurance. Sponsor may substitute a prize (or a portion of a prize) with one of equal or greater retail value if a prize (or a portion of a prize) is unavailable or cannot be awarded for any reason. Winner is solely responsible for the reporting and payment of any applicable federal, state and/or local taxes on his/her prize. The value of the prize set forth above represents Sponsor’s good faith determination of the ARVs thereof, and the actual fair market value, as ultimately determined by Sponsor, is final and binding and cannot be challenged or appealed. In the event the stated ARV of a prize is more than the actual fair market value of that prize, the difference will not be awarded in cash or otherwise. The Internal Revenue Service requires Form 1099 MISC to be issued and filed for any recipient who receives a prize, if the annual aggregate value of the prizes received is $600 or more. Sponsor will issue a Form 1099 MISC to winner for the fair market value of the prize, which may vary depending on the time of booking of travel.

SELECTION OF WINNER

Winner will be selected by random drawing conducted by New Homes Guide from among all eligible Entries received during the Sweepstakes Entry Period. Drawing date will be held on or about June 16, 2008 and winner will be notified by telephone and/or email on or about June 16, 2008. All Entries must include a daytime phone number, including area code, where you can be reached and an email address. Incomplete Entries will not be accepted. The odds of winning depend upon the total number of eligible Entries received. Sponsor not obligated to leave voicemail, answering machine, or other message when attempting to notify selected winner. In Sponsor’s sole discretion, a selected winner may be required to forfeit prize and an alternative winner may be selected in accordance with the Official Rules from among the remaining eligible entries for that prize if selected winner (i) is unreachable, (ii) declines or cannot accept, receive or use the prize for any reason, or (iii) fails to comply with these Official Rules.

LIMITATION OF LIABILITY AND GENERAL CONDITIONS

By participating in this Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of the judges, which are final and binding in all respects. By entering, each entrant agrees to release, discharge, indemnify, and hold harmless Sponsor and each of its parent companies, affiliates, subsidiaries and advertising and marketing agencies and each of their respective employees, officers, shareholders, directors, representatives and agents (collectively, “Releasees”) from and against any and all claims, damages or liability involving or arising out of (i) late, lost, delayed, misdirected, postage due, mutilated, incomplete, unreadable, inaccurate, garbled or unintelligible entries; (ii) telephone system, technical or computer malfunctions, lost connections, disconnections, transmission or other errors of any kind whether mechanical, human, electronic or otherwise; (iii) data corruption, theft, destruction, unauthorized access to or alteration of entry or other materials; (iv) any injuries, losses or damages of any kind caused, in whole or in part, directly or indirectly, by the prize or resulting from acceptance, possession or use or misuse of any prize or from participating in the Sweepstakes or any Sweepstakes related activity; or (v) any printing, distribution, typographical, administrative, human or technological errors involving or associated with the Sweepstakes. Sponsor disclaims any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with the Sweepstakes.

Sponsor reserves the right, in its sole discretion, to modify, cancel or suspend this Sweepstakes (or any portion of the Sweepstakes) should any virus, bug, computer problem or other cause or problem corrupt or inhibit the administration, security or proper operation of the Sweepstakes and, in such situation (or in the event of any type of error), to select the winner from eligible entries received prior to the action taken or in such manner as deemed fair and appropriate by Sponsor. In no event will Sponsor be liable for more than the stated number of prizes in the Official Rules. Sponsor may prohibit entrant from participating in the Sweepstakes or winning a prize if, in its sole discretion, it determines entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair practices or intending to annoy, abuse, threaten or harass any other entrant or Sponsor’s representatives. Releasees have not made and/or are not responsible for any misrepresentation or guaranty, express or implied, in fact or in law, relative to the prize. By accepting a prize, winner agrees and acknowledges that Sponsor may use winner’s name, voice, biographical data, likeness and city name in any and all media throughout the universe and in perpetuity for promotional purposes without additional compensation, except where prohibited by law. By entering Sweepstakes, entrants agree that: (1) any and all disputes, claims, and causes of action arising out of or connected with the Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action: (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering Sweepstakes, but in no event will attorneys’ fees be awarded or recoverable; and (3) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby knowingly and expressively waives all rights to seek, punitive, incidental or consequential damages and/or any other damages, other than actual out-of-pocket expenses, and/or any and all rights to have damages multiplied or otherwise increased.
